1. Acceptance of Terms
By accessing or using ERLC Directory at erlcglobal.com/directory (the "Service"), you ("User," "you") agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and UhFidler International ("Company," "we," "us"). We may modify these Terms at any time by posting the revised version through the Service. Continued use after a change constitutes acceptance of the modified Terms.
2. Eligibility
You must be at least thirteen (13) years of age to use the Service, consistent with Discord's own age requirement. If you are between 13 and 18, you represent that a parent or legal guardian has consented on your behalf. We do not independently verify age and rely on your self-certification at sign-in.
3. Description of Service
ERLC Directory is a public directory of Emergency Response: Liberty County operators, organizations, and the people affiliated with them. Authenticated users may create a public profile, claim an organization with proof of Discord-server ownership, invite affiliated members, and obtain an optional Verified Organization badge through paid subscription or active Club33 membership.
The Service uses Discord OAuth as its sole authentication method. We are not affiliated with, endorsed by, or sponsored by Discord Inc., Roblox Corporation, Police Roleplay Community (PRC), or any third party.
4. User Accounts and Conduct
4.1 Authentication
Sign-in is via Discord OAuth. You authorize us to receive your Discord username, avatar, and the list of Discord servers you are a member of (used to verify org-claim ownership). We never see your Discord password.
4.2 User-Generated Content
You may publish a profile bio, an organization name, description, and logo. You are solely responsible for the content you publish. You represent that you have all rights necessary to publish it and that it does not violate the rights of any third party. We may remove content at our sole discretion, including for violations of these Terms or applicable law.
4.3 Prohibited Conduct
You agree not to: (a) impersonate another person, brand, or organization; (b) claim an organization you do not own or are not authorized to represent; (c) post content that is unlawful, harassing, defamatory, hateful, or obscene; (d) use the Service to distribute malware or phishing material; (e) interfere with the Service's operation, security, or integrity; (f) scrape, crawl, or otherwise extract Service data outside of a normal user session; (g) attempt to gain unauthorized access to another user's account or our systems.
5. Verified Organizations
5.1 Verification Mechanic
"Verified" status grants an organization an orange checkmark and cascades a blue checkmark to confirmed affiliated members. Verification is granted in two ways: (a) a paid recurring subscription at the price stated on the pricing page (currently $10.99 USD/month per organization), or (b) free for users with an active Club33 membership in our license database.
5.2 Discord-Server-Ownership Proof
To claim an organization, you must designate a Discord server you own (we verify ownership server-side via the Discord API at the time of claim). Each Discord server may be claimed by only one organization. Verification is not a guarantee of identity, legitimacy, or trustworthiness — it confirms only that you own the designated Discord server.
5.3 No Implied Endorsement
The Verified badge is a payment- or membership-based mark. It does not imply endorsement, vetting, or any quality guarantee by ERLC Global, UhFidler International, or any third party. We may revoke verification at our sole discretion at any time, including for violations of these Terms, fraud, abuse, or chargebacks.
5.4 Member Cascade
An invited member must accept the invitation before publicly appearing on an organization's roster. The blue affiliated-member checkmark on a user's profile depends on the verification state of every organization they are confirmed in; if every such organization loses verification, the cascade ends and the badge is removed automatically.
6. Subscriptions, Payment, and Refunds
Paid verifications are processed by Stripe, Inc. Fees are charged in advance and billed monthly. By subscribing you authorize us, through Stripe, to charge your payment method on a recurring basis at the then-current rate until you cancel. You may cancel at any time through the dashboard or Stripe customer portal; cancellation takes effect at the end of the current billing period.
Due to the digital nature of the Service, all payments are final and non-refundable except as required by applicable law. Refunds may be issued at our sole discretion on a case-by-case basis. Initiating a chargeback or payment dispute without first contacting us in good faith may result in immediate revocation of verification and the underlying account.
If your Club33 membership lapses, any organizations you own that were verified through the Club33 path will lose verification automatically. You may resubscribe at the paid rate to retain verification.
7. Intellectual Property
All right, title, and interest in the Service — including its source code, design, branding, and proprietary identifiers — belong to UhFidler International. These Terms grant you no license to use our trademarks, trade names, or branding without our prior written consent. Logos uploaded as organization marks remain the property of their respective owners.
By submitting any feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and distribute that Feedback for any purpose without obligation or attribution.
8. DMCA Notice
If you believe content available through the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) including: (a) a signature of the copyright owner or authorized agent; (b) identification of the copyrighted work; (c) identification of the infringing material with sufficient detail to locate it; (d) your contact information; (e) a good-faith statement that the use is not authorized; and (f) a statement under penalty of perjury that the information is accurate.

9. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. We collect operational data necessary to run the Service (Discord identifier, username, avatar, OAuth tokens, organization claims, billing metadata via Stripe). We do not sell personal information to third parties.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
WE DO NOT WARRANT THE ACCURACY, LEGITIMACY, OR TRUSTWORTHINESS OF ANY USER PROFILE, ORGANIZATION, OR VERIFICATION DISPLAYED ON THE SERVICE. VERIFICATION IS A PAYMENT OR MEMBERSHIP MARK, NOT AN IDENTITY GUARANTEE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL UHFIDLER INTERNATIONAL OR ITS OWNERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless UhFidler International and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of applicable law or third-party rights; or (d) any content you submit, including any false claim of organization ownership. This obligation survives termination of these Terms.
13. Termination
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause, and with or without notice. Grounds include violation of these Terms, suspected fraud, chargebacks, lawful requests, and prolonged inactivity. Upon termination, your verified status is immediately revoked. Sections 7, 9, 10, 11, 12, 14, 15, 16, and 17 survive termination.
14. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND HAVE A JURY TRIAL.
14.1 Agreement to Arbitrate
You and UhFidler International mutually agree that any dispute arising out of or relating to these Terms or the Service ("Dispute") shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16.
14.2 Pre-Arbitration Notice
Before initiating arbitration, you must send written notice of the Dispute to us via our Discord server, describing the claim and the relief sought. If we cannot resolve the matter within sixty (60) days, either party may proceed to arbitration.
14.3 Class Action Waiver
YOU AND THE COMPANY AGREE THAT EACH MAY BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS.
14.4 Jury Trial Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL.
14.5 Opt-Out
You may opt out of this arbitration agreement by notifying us via Discord within thirty (30) days of first accepting these Terms. If you opt out, neither party can require arbitration. After thirty days, opt-out is no longer available.
14.6 Small Claims
Either party may bring an individual action in small claims court for Disputes within the jurisdictional limits of that court.
15. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. The Federal Arbitration Act governs Section 14. For Disputes not subject to arbitration, you consent to the exclusive jurisdiction of state and federal courts in Wyoming. Any cause of action must commence within one (1) year of accrual or be permanently barred.
16. Force Majeure, Severability, Assignment, Entire Agreement
Neither party is liable for failure or delay caused by events beyond their reasonable control (including third-party platform changes by Discord or Stripe). If any provision is held unenforceable, the remainder continues in effect. You may not assign these Terms without our written consent; we may assign freely. These Terms, together with the Privacy Policy and any supplemental notices, constitute the entire agreement and supersede all prior understandings.
